By accessing or using OhMyFans.org ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.
These Terms constitute a legally binding agreement between you and OhMyFans. By creating an account, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
You must be at least 18 years of age to use the Platform. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
You must not be prohibited from using the Platform under applicable laws, including but not limited to sanctions laws and regulations.
Creators must provide valid age verification and comply with all applicable record-keeping requirements under 18 U.S.C. § 2257.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
You are responsible for the security of your connected cryptocurrency wallet. OhMyFans has no ability to recover lost wallet credentials or reverse blockchain transactions.
Each person may only maintain one account. Creating multiple accounts may result in termination of all accounts.
The Platform permits legal adult content created by and featuring consenting adults (18+). The following content is strictly prohibited:
We reserve the right to remove any content that violates these guidelines and to terminate accounts of repeat offenders without notice.
As a creator, you represent and warrant that:
Creators grant OhMyFans a non-exclusive, worldwide license to display, distribute, and promote their content within the Platform for the purpose of operating the service.
As a subscriber, you agree that:
Peer-to-Peer Payments: All subscriber payments (subscriptions, tips, pay-per-view, and paid messages) are sent directly from the subscriber's Solana wallet to the creator's Solana wallet using USDC stablecoin. OhMyFans does not receive, custody, hold, or process subscriber payments at any point.
Subscription Obligation: By creating a creator account on OhMyFans, you accept a continuous subscription obligation for platform marketplace access. This obligation is established at account registration before any subscriber transaction occurs and exists independently of any individual payment, tip, or subscriber interaction on the platform. The subscription obligation continues for each billing period regardless of whether subscriber transactions have occurred during that period. Tier threshold crossings during a billing period make the applicable subscription amount determinable for that period — they do not create, trigger, or modify the underlying subscription obligation, which pre-exists any such event.
Platform Subscription Fee: OhMyFans charges creators a flat monthly platform subscription fee determined by a bracket lookup based on prior month earnings. The subscription is a fixed dollar amount — not a percentage calculation. Two creators with different earnings within the same bracket pay the same subscription.

Monthly Reset: Tiers reset on the first of every month. There is no permanent tier assignment. A slow month costs less or nothing.
Prepayment Option: Prepayment is the voluntary early exercise of the pre-existing subscription obligation established at account registration. When a creator crosses into a new subscription tier during a billing month, the prepay option becomes visible on their dashboard. Creators may prepay their subscription at any time at a discounted amount as shown in the fee schedule above. The discount scales with tier — higher tiers receive larger discounts. Prepayment does not alter the subscription obligation, the subscription calculation method, or the total subscription amount owed for any billing period. Prepay amounts are credited toward the month-end subscription obligation. OhMyFans sends a weekly Sunday evening SMS reminder to creators who have crossed a tier but not yet prepaid. Prepayment is always optional and creator-initiated. OhMyFans cannot extract funds from any wallet. Prepayment discounts and amounts are set by OhMyFans and may be adjusted with 30 days written notice.
Invoicing: If a balance remains at month end, an invoice is generated with a 7-day payment window. Failure to pay within 7 days may result in account suspension until the balance is paid in full.
Blockchain Transactions: All subscriber payments are recorded on the Solana blockchain and are publicly verifiable. Network transaction fees are the responsibility of the sender.
No Refunds — Subscriber Payments: Due to the peer-to-peer nature of blockchain transactions, OhMyFans cannot issue refunds for subscriber payments. All payments are final once confirmed on the blockchain.
No Refunds — Platform Subscription: Platform subscription payments are non-refundable under all circumstances. The monthly platform subscription fee constitutes payment for marketplace access during the applicable billing period. Access having been provided, no refund is available regardless of account termination reason, timing within the billing period, or earnings level during that period.
OhMyFans offers a two-tier referral program. Every creator receives a unique referral link at signup. When another creator joins through that link, a permanent referral relationship is established.
Commission Rates:
Commissions are calculated on the standard platform subscription fee and rounded to the nearest whole dollar. No fractional amounts.
Eligibility Requirements:
To receive referral commissions in any calendar month, you must meet both of the following conditions simultaneously:
The same eligibility conditions apply to referred creators — a referred creator must meet both conditions that month to generate commissions for their referrer. Both conditions reset monthly. Failure to meet either condition in a given month forfeits that month's commissions only.
Permanent Relationships:
Referral relationships are permanent for the life of the referred creator's account. They do not expire, time out, or require renewal. Account inactivity acts as a pause — commissions do not flow that month, but the relationship is preserved. Commissions resume automatically when eligibility conditions are met again. Only permanent account termination by OhMyFans for policy violations ends a referral relationship.
Chain Behavior:
A Tier 1 creator's inactivity, account pause, or cancellation does not break Tier 2 commission flow. Once a Tier 2 relationship is established it is permanent and independent of the Tier 1 bridge creator's status. Your Tier 2 network is your asset.
Commission Source:
All commissions are paid from OhMyFans operating revenue — from platform margin. Referred creators pay the same flat subscription as every other creator. No creator ever pays more because referrers exist above them. Commissions are paid monthly in USDC to your connected wallet.
No Accrual:
Each month stands alone. Commissions not earned in a given month are not carried forward, deferred, or owed. The platform profits nothing from any creator's inactivity.
Disclosure Requirement:
You must disclose your material connection to OhMyFans in all promotional content that includes your referral link. Required disclosure: "I earn commissions when creators I refer join OhMyFans and pay platform subscription fees." Failure to disclose may result in suspension of referral privileges.
Income Claims Prohibited:
You may not make earnings representations, income projections, or lifestyle claims in connection with the referral program. You may not show personal commission amounts as typical results or suggest referral income is guaranteed.
No Recruitment Pressure:
Referring creators may not contact, pressure, manage, direct, or solicit referred creators in connection with their content creation activities. The referral relationship is a passive commission arrangement only. Referred creators are independent platform participants who make their own content and business decisions. If a creator reports being pressured by their referrer, this constitutes a Terms of Service violation resulting in immediate and permanent termination of all referral privileges for the referring creator. The referred creator's account is not affected.
Founding Creator Exemption:
The first 1,000 verified registered creator accounts on OhMyFans receive a permanent and irrevocable exemption from the referral eligibility requirements set forth above. Founding creators earn referral commissions without meeting the $100 minimum earnings or 2 unique subscriber wallet requirements. This exemption exists to address the structural impossibility of satisfying activity-based eligibility requirements on a newly launched platform prior to the establishment of a subscriber base.
Founding creator status is determined solely by account registration sequence — an objective criterion with no discretionary component. The exemption is hard-capped at 1,000 accounts and closes permanently and irrevocably when that limit is reached. This limit is enforced in the platform's registration code and cannot be extended, reopened, or modified.
Creators referred by a founding creator are not themselves founding creators unless they independently qualify by registration sequence. All referred creators in a founding creator's network follow the standard eligibility rules set forth above. The founding creator exemption applies only to the founding creator's own eligibility — not to the eligibility of anyone in their referral chain.
Founding creator status is permanent for the life of the account. It survives account inactivity, commission pauses, and any modification to the referral program terms. Founding creator status cannot be revoked, downgraded, or made conditional after assignment except upon permanent account termination by OhMyFans for violation of these Terms of Service.
Tax Reporting:
Referral commissions are taxable income paid by OhMyFans and are subject to IRS reporting requirements. Before any referral commission is paid, you must submit a completed W-9 form (US persons) or W-8BEN form (non-US persons), including your legal name, address, and taxpayer identification number (Social Security Number or Employer Identification Number). OhMyFans will issue a 1099-NEC to any creator receiving $600 or more in referral commissions in a calendar year and will file the corresponding information return with the IRS. Commission payments will be withheld until a valid W-9 or W-8BEN is on file. OhMyFans retains tax documentation as required by law.
Referral Income — Privilege and Earned Commissions:
Participation in the referral program and the right to earn future referral commissions is a revocable privilege of platform participation, subject to modification or termination by OhMyFans with 30 days' written notice. Referral income does not constitute wages, salary, or compensation for services and does not create any employment or independent contractor relationship between OhMyFans and any creator.
Notwithstanding the foregoing, referral commissions calculated for any calendar month in which a creator met all eligibility conditions constitute earned obligations that OhMyFans is obligated to pay regardless of subsequent account status, program modifications, or termination. No earned commission may be forfeited, withheld, or offset against any other obligation except as provided in the Termination Settlement section below or as required by law.
Program Modification:
OhMyFans reserves the right to modify referral program terms, commission rates, and eligibility requirements with 30 days' written notice to affected creators. Notwithstanding the foregoing, no modification to the referral program may revoke, diminish, or make conditional the permanent founding creator exemption described above. Founding creator status and the associated eligibility exemption are irrevocable contractual rights that survive any program modification. Abuse of the referral program — including self-referrals, fraudulent accounts, or artificial inflation of referral metrics — will result in forfeiture of all commissions and potential account termination.
OhMyFans respects the intellectual property rights of others and expects its users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and will respond to valid takedown requests.

Repeat copyright infringers will have their accounts terminated in accordance with our repeat infringer policy.
We may terminate or suspend your account at any time, with or without cause, with or without notice. Grounds for termination include but are not limited to:
For purposes of these Terms, inactivity means a period of twelve (12) consecutive months during which a creator has not logged in, posted content, received subscriber payments, or paid a platform subscription. OhMyFans will provide 30 days' written notice before terminating any account for inactivity. Inactivity alone shall not constitute grounds for termination of an account holding Founding Creator status.
Upon termination, your right to use the Platform ceases immediately. Any USDC already in your wallet remains yours, as we do not custody your funds. All referral relationships end on the termination date and no future referral commissions accrue after termination.
Termination Settlement:
Upon account termination or cancellation for any reason, OhMyFans will calculate any outstanding subscription balance owed by the creator and any earned unpaid referral commissions owed to the creator as of the termination date.
Earned unpaid referral commissions will be applied as an offset against any outstanding subscription balance. If earned commissions equal or exceed the outstanding balance, the balance is fully satisfied and any remaining commissions are paid to the creator's wallet within the standard payment window. If earned commissions are less than the outstanding balance, the commissions are applied and the remaining balance is voided.
OhMyFans will not pursue collection of any remaining subscription balance from any creator whose account has been terminated or cancelled. No creator has any continuing financial obligation to OhMyFans after account termination or cancellation.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OHMYFANS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM.
OhMyFans is not responsible for any losses arising from blockchain transactions, including but not limited to: wallet compromises, incorrect wallet addresses, network failures, or smart contract vulnerabilities.
OhMyFans' total financial liability to any creator is limited to: (a) unpaid referral commissions earned in months where all eligibility conditions were met and which have not yet been paid; and (b) no other financial obligation of any kind.
Platform subscription payments are non-refundable and create no liability for refund or credit. Future referral commissions are a revocable privilege and create no financial liability prior to the month in which they are earned.
You agree to indemnify, defend, and hold harmless OhMyFans, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your content; (d) your violation of any third-party rights; or (e) any tax obligations arising from your earnings on the Platform.
OhMyFans is operated by Kris Naz LLC, a New Hampshire limited liability company.
These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law provisions.
Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts of the State of New Hampshire. You consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms constitute the entire agreement between you and OhMyFans regarding your use of the Platform and supersede all prior agreements.
